Vessel Damage & Return of Deposit Policy

Renters are responsible for leaving the Boat in the same condition it was in when they collected the boat, fair wear and tear excepted. Renters acknowledge and agree that they are responsible for their own acts and omissions and are also responsible for the acts and omissions of any individuals who you invite to, or otherwise provide access to the Boat. Book My Boat charges Renters the Security Deposit the Renter agreed to pay with the Owner as part of the initial hire transaction.

Off Hire Procedure

At the completion of the Rental the Owner is required to follow the Off Hire Procedure to assess the boat. If the Owner believes there has been damage sustained and can prove it using the pre and post hire inspection reports 9including photos), then they should notify Book My Boat of a dispute and promptly either seek quotes to repair the damage caused by the Renter or notify their insurance company of a potential claim.

The Renter will be advised that the Owner claims that damage occurred during the Rental Period. If the Renter accepts their responsibility then Book My Boat will, provided the Owner has a quote to repair the damage, apply the Security Deposit towards this loss.

If the Renter does not respond within two days of being advised of the damage claim, the Owner’s loss will be deducted from the Security Deposit (if any).

If the Owner’s loss is less than the Security Deposit then the balance of the deposit will be returned to the Renter. If the Owner’s loss is greater than the deposit it is recommended to the Owner to seek damages directly from the renter and/or consider settlement or lodge of an insurance claim with their insurance provider.

If the Renter disputes their liability for the damage to the Boat then Book My Boat will follow the Dispute Resolution Process. The Renter and Owner agree to assist Book My Boat and act in good faith during dispute resolution. Owners and Renters will provide Book My Boat with information and take actions as may be reasonably requested by Book My Boat to assist in resolving the dispute.

Return of Deposit

The Security Deposit will be held until both parties have marked the rental as successfully completed or until Book My Boat, acting reasonably and following the Dispute Resolution Process, determines that the deposit (or part thereof) should be returned to the Renter or given to the Owner to compensate for damage arising from the Rental.
